Waterfront Property Ownership in Texas: Texas has three basic types of waterfront property: oceanfront, lakefront, and riverfront. Within these three waterfront properties; fishing regulations, access and property ownership vary greatly. While oceanfront and riverfront are topics for another time and place, it is quite appropriate to take up lakefront property ownership here.

  • Fishing regulations are issued by the Texas Parks and Wildlive Deptartment (TPWD) on an annual basis and vary by lake. These regulations are available via internet using the above link, or through the Hunting and Fishing Handbook published each year by the TPWD.

  • Reservoir Controlling Authorities own, operate, and/or administrate the lakes of Texas. These Authorities determine the lake use, access, and property use for each lake within their authority. Reservoir Controlling Authority types operating in Texas lakes are:

    • US Army Corps of Engineers (USACE) operates the so-called "corps lakes" in Texas. Generally, these lakes were originally built for flood control, but have turned into major recreational centers. Private waterfront property (shoreline) ownership is not allowed. However, a large community of waterview property owners has grown up around most of the "corps lakes" in Texas.

    • State River Authorities have been enabled by state law to build, own, operate, and/or administrate lakes. Each River Authority operates within geographic boundries set by state law, and issues the regulations governing each lake within their authority. River Authority lakes have been built for various reasons, however, private waterfront (shoreline) ownership is generally the rule.

    • Regional Water Districts have also been enabled by state law to build, own, operate, and/or administrate lakes. Each Regional Water District operates within geographic boundries set by state law, and issues the regulations governing each lake within their authority. Regional Water District lakes are usually built as water reservoirs suppling water treatment plants withing their district. Private waterfront (shoreline) ownership is the general rule.

    • Cities may also build, own, operate, and/or administrate lakes. City lakes are usually built as water reservoirs suppling the city water treatment plants. Private waterfront (shoreline) ownership varies by City.

    • Water Control and Improvment Districts are similar to Regional Water Districts. Private waterfront (shoreline) ownership varies by Lake.

    • Power Plant Lakes are built, owned, operated, and/or administrated by power generating companies. As a general rule, Private waterfront (shoreline) ownership is not allowed, and access is restricted.
